Yargıtay Kararları Işığında Babaya Görüş Sınırı: Boşanmış babalar’ dernekleri çocuklarını her hafta görme tezini savunurken, Yargıtay 2. Hukuk Dairesi, velayeti alan anneleri koruyan ve ‘çocuğun üstün yararını’ kriter alan önemli bir karar verdi. Yargıtay kararında, “Mahkemece her hafta sonu kurulan kişisel ilişki anneyi tüm hafta sonları eve bağımlı hale getirecek ve velayet görevini gereği gibi yerine getirmesine engel olacaktır” denildi. Yargıtay 2. Hukuk Dairesi Başkanı Uğur Ömer Gençcan son örnek kararı şöyle anlattı: “Erkek eşlerin tamamı ve erkek dernekleri, ‘Çocuklarımızla her hafta görüşemiyoruz. 15 günde bir görüşmek zorunda kalıyoruz’ diye itiraz ediyorlar. Daire olarak biz onların bu isteğine uyarsak ve her hafta kişisel ilişki verirsek ne olacak? Velayeti almasına rağmen anne bir hafta sonu bile çocuğunu alıp denize, pikniğe, sinemaya gidemeyecek. Kadın eve bağımlı hale gelirken, erkek 52 hafta gezecek. Kadın çalışıyorsa, bir hafta sonu var. Babanın çocuğu gelip ne zaman alacağı belli değil. Canı istediği zaman geliyor. Kadın akşama kadar nöbetçi asker gibi evde bekleyecek mi? Çocuk açısından sıkıntı var. Her zaman boşanan eşler aynı şehirde olmuyor. Baba köyde anne şehirde oturuyor. Çocuk kalkıp her hafta sonu köye gidecek. Kursu varsa gidemeyecek. Çocukların her hafta seyahate zorlanması yanlıştır. Her hafta yer ve ortam değişikliği de çocuğun üstün yararına aykırıdır. Yargıtay olarak ‘kardeş payı’ yaptık. ‘Boşanan eş/baba, velayeti annesindeki çocukla her hafta görüşmesin’ dedik. Çocuk iki hafta annede, iki hafta babada kalsın kararı verdik.
